Terms and Conditions
1. General Terms
1.1. By making a booking with Epic Ocean Encounters you agree to be bound by these terms and conditions. Please read them carefully before confirming your booking.
1.2. These terms apply to all tours and services offered and booked by Epic Ocean Encounters unless otherwise stated.
2. Booking and Confirmation
2.1. To book a tour, a valid reservation must be made via www.epicoceanencounters.com or [email protected] and full payment or 20% deposit is required to confirm the booking.
2.2. A booking is considered confirmed when you receive a booking confirmation from Epic Ocean Encounters which will include the details of your tour and payment receipt.
2.3. When a deposit is paid, the remaining balance must be settled according to the payment schedule specified in your confirmation email.
2.4. All rates and terms are subject to change.
2.5. This booking is binding and all payments are non-refundable unless Epic Ocean Encounters is required to cancel in unforeseeable circumstances.
3. Payments
3.1. Payment can be made via Credit Card or Bank Transfers. All payments will be billed in USD currency. A booking will not be confirmed if deposit is not made within the specified timeframe.
3.2 A payment schedule will be provided until the booking is paid in full 60 days prior to the confirmed booking. Payment schedule will be provided at the time of your booking.
3.3. Full payment is due 60 days before the tour departure date unless otherwise agreed. If payment is not received in full by this time, Epic Ocean Encounters reserves the right to cancel the booking with no refund.
3.4. In case of group bookings Epic Ocean Encounters will require a 20% deposit with payment schedule specified in your booking confirmation. Full payment will need to be made 60 days prior to your tour departure.
4. Cancellations and Refunds
4.1. Payments made are non-refundable.
4.2. If Epic Ocean Encounters cancels the tour due to unforeseen circumstances, you will be offered an alternative tour or a full refund.
4.3. No refunds will be issued for missed tours or late arrivals.
4.4. If you wish to transfer your booking to another person, you must notify Epic Ocean Encounters at least 60 days in advance, a transfer fee may be applicable.
5. Changes to Booking
5.1 Changes may be subject to additional fees and availability.
6. Insurance
6.1. Travel insurance is mandatory for all Epic Ocean Encounter bookings, guests should take out a policy during the time of your booking. Your travel insurance policy must include cover against death, personal accident, medical expenses related to diving or snorkelling (specific to your tour activities). We strongly recommend the cover includes flight cancellation, personal liability, and loss of luggage.
6.2. Epic Ocean Encounters holds no responsibility for any loss, injury, or damage to personal property during the diving or expedition activities.
7. Health and Safety
7.1. By booking a tour, you confirm that you are in good health and able to undertake the activities included in the tour. Epic Ocean Encounters requires guests to complete a personal questionnaire and liability waiver prior to the commencement of your tour.
7.2. If you have any pre-existing medical conditions, disabilities, or require special assistance, you must inform Epic Ocean Encounters at the time of booking.
7.3. Epic Ocean Encounters reserves the right to refuse participation in the tour if your health or factors considered unsuitable for the activities or poses a risk to other participants.
8. Liability
8.1. Bookings made between you and the organiser, Epic Ocean Encounters is an agreement as set out in these terms and conditions. Epic Ocean Encounters acts as a booking operator and organises tours with operators. In case of circumstances that are unforeseen directly with the operator Epic Ocean Encounters cannot be held liable.
8.2. You are responsible for your own belongings and gear during the tour. Epic Ocean Encounters will not be liable for any lost, stolen, or damaged property.
8.3. In the event of an accident or emergency, you agree to follow the instructions of the tour guide or staff at all times.
9. Force Majeure
9.1. Epic Ocean Encounters shall not be liable for any failure or delay in performing its obligations under these terms and conditions due to events beyond its reasonable control, including but not limited to natural disasters, weather conditions, political instability, or strikes.
10. Complaints
10.1. If you have any complaints or concerns during your tour, please inform the tour guide or Epic Ocean Encounter representative immediately in writing.
11. Privacy Policy
11.1. Your personal information is collected for the purpose of processing your booking and providing you with tour services. Your personal details will be provided only to the operator relevant to your tour or any operators i.e. transfers, boat operators and if relevant accommodation providers in line with your reservations and booking.
12. Photography and Media
12.1. Epic Ocean Encounters may take photographs or videos during the tour for promotional purposes. By participating in the tour, you consent to the use of such media unless you inform us otherwise in writing.
13. Equipment and Conduct
13.1 Clients must follow all instructions from the dive or expedition leaders, and adhere to all safety guidelines during the activity.
14. Special Requests and Requirements
14.1. If you have special requests (e.g., dietary preferences, mobility requirements, etc.), please notify us at the time of booking. We will make reasonable efforts to accommodate your requests but cannot guarantee that all special requests will be met.
15. 1 Animal Sightings Disclaimer
While we strive to provide an exciting and rewarding experience, please note that sightings of specific wildlife are not guaranteed. These animals are wild and their appearance is subject to natural conditions, including weather, migration patterns, and other environmental factors.
15.2 Safety and Environmental Considerations
The safety of all guests and the protection of wildlife are our primary concerns. Our crew will always prioritize responsible and sustainable wildlife viewing, and we reserve the right to adjust the safari route or schedule if conditions are not suitable for animal sightings or if safety concerns arise.
15.3 Changes to Itinerary
The itinerary may change depending on the weather, sea conditions, and the safety of participants. The operator reserves the right to cancel or modify the safari in accordance with these factors.
